The participation in all online and social media competitions of IARS UG (haftungsbeschränkt) is subject to the following terms and conditions: 

 

The organiser of the promotion is IARS UG (haftungsbeschränkt) , Kaufbeurer Straße 8 1/2, 87437 Kempten, Germany, hereinafter referred to as IARS. 

 

The sweepstakes are in no way connected to Facebook Ireland Limited Hanover Reach. Furthermore, the competition is not sponsored, supported or organized by Facebook. There are no legal claims against Facebook.   

 

Right to participate

In principle, all persons over the age of 18 are eligible to participate. Participants under the age of 18 have no legal claim to winnings. Eligible to participate are people who are resident in country of the European Union, employees and other staff of IARS and all employees of third parties involved in the implementation of this promotion, as well as persons who live in a shared apartment or similar community with the persons listed above, are not eligible to participate. Representatives are not allowed to participate in the promotion.

 

Participation opportunities

Participants may enter the competition in accordance with the description published together with the respective competition. Participation is possible without the purchase of IARS  products.

 

Profits

The products listed in the competition description will be raffled off among all users participating in the competition. The organizer is released from the obligation to pay the prizes by the handover. A cash payment or transfer of the prize is not possible. The organizer reserves the right to replace the prizes with a comparable other prize. The transfer of the prize is not possible.

 

Procedure

Participation in the competition is by fulfilling the requirements for participation listed in the competition description. Participants who enter inappropriate, offensive, sexist or racist content or content that promotes irresponsible use of IARS products will be excluded from the competition. Each participant can only enter the competition once. IARS reserves the right to replace the prizes with similar prizes of equal value. IARS will select the winner at random from all participants. The winner will be notified by IARS by e-mail or message on social networks and must reply within 3 days whether he/she wishes to accept the prize. After these three days, the right to the prize expires. 

 

Offence against the conditions of participation

IARS reserves the right to disqualify any person from the promotion in the event of a breach of the terms and conditions of participation or in the event of intentional or unintentional misrepresentation of the conditions of participation. Also excluded are persons who use unauthorised aids or otherwise gain an advantage by manipulation. In such cases, articles that have been awarded retrospectively may be withdrawn and reclaimed.

 

Limitation of liability

IARS is not liable for damages caused by errors, delays or interruptions in data transmission, malfunctions of technical equipment and service, incorrect content, loss or deletion of data and viruses. IARS does not accept any liability for damages of any kind after the prize has been handed over. Excluded from this are damages resulting from injury to life, body or health caused by intentional or negligent breach of duty by IARS or its vicarious agents. In this case, liability is limited to the legally permissible minimum.

 

Cancellation or termination of the lottery

The opportunity to participate in the competition automatically ends on the last day of the promotion at the time specified by IARS in the competition description. IARS reserves the right to cancel or terminate the promotion at any time without notice. This applies in particular, but not exclusively, to cases in which for technical reasons - e.g. infection of the computer system with viruses, manipulation or errors in the hardware and/or software or for legal reasons - a proper execution of the promotion is made difficult, influenced or impossible. IARS assumes no liability for lost awarded items. If such a termination is caused by the behaviour of a participant, IARS can demand compensation from this person for the damage incurred.

 

Miscellaneous

The judges' decision is final. A cash payment of the awarded articles is expressly excluded. A transfer of the awarded articles is not possible. German law applies to these conditions of participation. Should one of the present provisions be invalid in whole or in part, the validity of the remaining provisions shall not be affected.

 

Data protection

IARS assures to respect the legal regulations of data protection and to use all - also personal - data of the participants only for the purpose of the execution of this promotion and to pass them on to third parties only as far as this is necessary for the execution of the promotion or for its execution. IARS confirms that third parties are obliged by a contractual agreement with IARS to also comply with the legal provisions of the Data Protection Act when processing personal data. The participant agrees that his/her data may be processed by computer.

 

Subject to change

IARS reserves the right to change or amend these conditions of participation at any time without giving reasons, insofar as this is necessary in the interests of simple and secure processing and in particular to prevent misuse or for other reasons. The information provided will be used solely for the purpose of communicating and sending the articles.
